1) Who we are

These Terms of Use (“Terms”) govern your access to and use of the website operated by Desert Thistle FC (“Desert Thistle FC,” “we,” “us,” or “our”) at desertthistlefc.com and any pages that link to these Terms (collectively, the “Site”).

By using the Site, you agree to these Terms.

2) Other policies that apply

Your use of the Site also involves:

Privacy Policy (how we collect and use personal data)
Cookies Policy (how we use cookies and similar tech)
Any Enrollment Terms, Player Code of Conduct, Parent Code of Conduct, or other service-specific terms that apply to programs you join (collectively, the “Related Policies”).

If these Terms conflict with a service-specific agreement you sign for an academy program, that service-specific agreement will control for that program.

3) Eligibility & Accounts

You must be at least 13 to use the Site. If you are under the age where you live to consent to online services, you must have a parent/guardian do so on your behalf.
You’re responsible for keeping any login credentials confidential and for all activity under your account if any.

4) Site content & intellectual property

The Site and all content on it (text, images, logos, graphics, videos, software, design, and look-and-feel) are owned by or licensed to Desert Thistle FC and protected by copyright, trademark, and other laws.
You may view, share links to, and print reasonable portions of the Site for personal, non-commercial use only.
You may not copy, modify, distribute, sell, rent, frame, scrape, reverse engineer, or create derivative works from the Site or its content without our prior written consent.
Our names, logos, and marks are our trademarks. You may not use them without written permission.

5) Your content

If you submit, upload, or post content (for example: comments, reviews, photos, forms, or messages) (“User Content”):
You promise you own it or have all rights needed to share it with us and the Site.
You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, host, store, modify, display, and distribute your User Content for operating, improving, and promoting the Site and our services.
Do not submit User Content that is illegal, defamatory, harassing, hateful, obscene, infringing, invasive of privacy, or otherwise objectionable.
We may remove User Content at any time in our discretion.

6) Acceptable use

You agree that you will not:

Break the law or infringe any third-party rights.
Try to gain unauthorized access to the Site, other accounts, or our systems.
Introduce malware, bots, or harmful code; overload or disrupt the Site.
Use data mining, scraping, or similar methods without our permission.
Impersonate others or misrepresent your affiliation.
Use the Site to advertise or solicit without our written consent.

7) Information on the Site

We aim to keep the Site accurate and up to date, but information may be updated, corrected, or changed at any time without notice. Schedules, prices, availability, locations, and program details are subject to change. The Site may include typos or inaccuracies. The Site is for general information only and does not constitute professional, medical, legal, or training advice.

8) Third-party services & links

The Site may link to third-party websites, apps, or services (e.g., payment processors, email tools, mapping, social media). We don’t control them and aren’t responsible for their content or policies. Your use of third-party services is governed by those providers’ terms and policies.

9) Program enrollment, payments & refunds

Program enrollment, training sessions, leagues, tournaments, uniforms, and related fees are governed by our Enrollment Terms and Codes of Conduct (and any invoice or offer letter you receive). Those documents set the rules on eligibility, selection, fees, payment timing, cancellations, credits, and refunds for programs. If you are considering a program, please review those documents carefully before paying.

10) Health & safety notice (website use context)

Any information about sports activities on the Site is general. Participation in sports involves inherent risks. Actual program participation is governed by the service-specific waivers/consents in the Enrollment Terms.

11) No warranties (the Site is provided “as is”)

To the maximum extent permitted by law, the Site is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant the Site will be uninterrupted, secure, error-free, or free of malware, or that defects will be corrected.

12) Indemnity

You agree to defend, indemnify, and hold harmless Desert Thistle FC and our directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your (a) use of the Site, (b) violation of these Terms, or (c) infringement or violation of any third-party right.

13) Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Site after changes means you accept the updated Terms.

14) Suspension & termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms, posed a risk to other users, or for any operational reason.

15) Copyright complaints

If you believe content on the Site infringes your copyright, email us at info@desertthistlefc.com with:

(1) your contact details; (2) a description of the copyrighted work; (3) the URL/location of the allegedly infringing material; (4) a statement that you have a good-faith belief the use is not authorized; and (5) a statement under penalty of perjury that your notice is accurate and you are the copyright owner or authorized to act for the owner.

16) Communications & electronic records

You consent to receiving communications from us electronically (e.g., email, notices on the Site) and agree that such communications satisfy any legal requirement that they be in writing.

17) International users

We operate from the United Arab Emirates. If you access the Site from outside the UAE, you’re responsible for compliance with local laws.

18) Force majeure

We won’t be liable for any delay or failure caused by events beyond our reasonable control, including acts of God, internet/telecom failures, outages, government actions, labor disputes, or events affecting our providers.

19) Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations freely to an affiliate or in connection with a merger, acquisition, or sale of assets.

20) Severability; no waiver; entire agreement

If any part of these Terms is found invalid, the rest remains in force. Our failure to enforce a right is not a waiver. These Terms, together with the Related Policies, are the entire agreement between you and us regarding the Site.
